Definition
A Business Associate Agreement, or BAA, is a legally binding contract between a covered entity and a business associate that outlines the responsibilities for protecting electronic protected health information (ePHI). This agreement ensures that any third party handling sensitive patient data adheres to HIPAA security and privacy rules. In practice, a BAA establishes clear guidelines for data use, disclosure, and safeguarding, preventing unauthorized access or breaches. It is crucial for maintaining compliance and protecting patient confidentiality in healthcare IT environments. For instance, a cloud storage provider that hosts patient records for a hospital must have a BAA in place with that hospital. Unlike a standard service agreement, a BAA specifically addresses HIPAA regulations and the handling of protected health information. This concept is frequently tested on security certifications like CompTIA Security+ and CySA+.
